Clock starts ticking for landlords to declare tax gains



Here is another warning about buy-to-let investors who have sold up and not told the taxman about their profits. They can expect to receive penalty letters from HMRC.


Accountants James Cowper says the crackdown, part of HMRC’s Property Sales Campaign, will affect landlords and second-home owners who have sold properties in both the UK and abroad.

Stephen Barratt, private client tax director at James Cowper, said: “Capital Gains Tax is applicable when a property, which is not a main home, is sold at a profit that tops the annual CGT allowance, which is currently £10,600.

“HMRC may dig back into the records and many ordinary people who were unaware of the rules could be in for an unpleasant surprise. There are reliefs available to reduce the tax on second homes, but specific planning in advance is required.”

Owners have until August 9 to tell HMRC about any unpaid tax on property sales, and a further four weeks until September 6 to pay the tax owed. Those who disclose voluntarily will pay lower penalties.

Barratt said: “It is important that those affected seek professional advice because it is important that those preparing the calculations fully understand the complex rules and so ensure that the tax, and therefore any penalty and interest, are kept to a minimum.

“For instance, the tax bill might be considerably lower if the property has been let out as holiday accommodation as a means of funding its upkeep. HMRC will not fulfill this advisory role.

“It is equally important that those who have recently acquired a second home or are contemplating a sale of one take advice. Simple, early planning can often help minimise future tax bills.”

60% of renters expect to never buy a home

Six out of ten tenants do not think they will ever own a home, according to a report by Castle Trust.


The housing investment and mortgage provider found that three million social renters and 1.5 million private tenants do not expect to buy a property.

Meanwhile, of the three million people who do envisage themselves owning a home, half think it will be at least five years before they look to buy.

Earlier this year, Castle Trust carried out research that showed the number of renters in the private sector grown substantially. There were 3.8 million private tenants in 2012, which is an increase of 23 per cent on the 3.1 million figure for 2008.

Sean Oldfield, chief executive officer at Castle Trust, said: “Many people are either unable to get on the property ladder or stuck in their current home, despite interest rates still being at an all-time low."

Clean up or clear off!


As more and more people turn to renting, the Association of Residential Letting Agents (ARLA) is warning would-be tenants to watch out for rogue letting agents. ARLA's key warning signs for prospective tenants to be aware of are:

  • Not allowed to see the whole property?
Be wary of agents who refuse full viewing and inspection of the property. At best, there may be problems behind closed doors; at worst, they may be showing you around a property that is already being rented to another individual, who might be staying on in that room. Always thoroughly inspect the property, checking every room. It is also a good idea to do your research on the local area, both on-line and in person, to make sure it is suited to your needs.
  • Do you know what the logo means?
Keep an eye out for non-accredited third party logos or accreditation being used by agents to look as if they are monitored and adhere to a set code of conduct. This can be used to lure prospective tenants into a false sense of security. Always check that agents are affiliated to a professional organisation like the ARLA using the appropriate website to confirm. 
  • Can't get in contact with the agent or landlord?
If you are searching on-line or via notice boards, be cautious of adverts with no telephone numbers or adverts that only use free email hosts. Ring the phone number on the advert to check its authenticity. Unscrupulous 'middlemen' may use false phone numbers or phone numbers they find on-line.

The Association of Residential Lettings Agents (ARLA) is also saying "clean up or clear off!" to letting industry rogues, suggesting that rogue letting agents and landlords should either mend their ways or quit the market. Tenant demand will continue to outstrip supply this year, with more families opting - or having - to rent.

Ian Potter, managing director of ARLA, said the situation will be particularly acute in London and the South-East. He said: “This increased demand will put quality and standards under a greater spotlight. This year, it will be time for unscrupulous agents and landlord to put up or shut up. Consumers are rightly calling for much higher standards in the private rented sector.”


He claimed: “We are seeing demand for licensed ARLA agents grow amongst tenants and landlords alike.” Potter also said there will be no slowdown in rent levels: “When it comes to rent levels, as long as the shortage of housing stock continues, it is unlikely that there will be any relief on rising rents throughout 2013.



“Indeed, in urban areas the demand for single-person occupancies may well continue throughout 2013, which will increase the existing pressure on high-demand properties and areas.”
